CASE .01
Mr. Ali is working as a sales manager in a multinational company. One of his colleagues (Mr. Sharafat) needs one million rupees on urgent basis as his mother is having cardiac problem and admitted in a hospital. She must be operated as soon as possible. Mr. Sharafat is facing shortage of money now a day; so he contacts Mr. Ali to borrow some money. Mr. Ali is ready to help him on humanitarian grounds but problem is that he is also facing shortage of money as his cousin (Mr. Salman) has already borrowed one million rupees from him which he is liable to return him within few days. So, Mr. Ali promises to lend one million rupees to Mr. Sharafat if Mr. Salman will return money. Unfortunately, Mr. Salman dies before the payment of money.
The Requirement:
1. You are required to identify the type of contract between Mr. Ali and Mr. Sharafat and also provide justifications to support your answer. (5 Marks)
2. What is the status of contract between A & S? (5 Marks)
CASE .02
A has to leave for other city on train due to sudden happening. Actually one of his uncles died in a road mishap over there. It is very shocking situation for him. When he reaches at the railway station, B, a coolie takes his luggage without asking him. A does not object to it. When he reaches in the train, B demands wages from A. B can get payment from A.
The Requirement:
1. You are required to identify the contract type between A & B and provide justifications to support your answer. (5 Marks)
